1. Terms and Conditions
FuegoStar.com is a Meta Search engine. By registering for Fuegostar.com,
the site and (The "rewards contests"), YOU ARE CONSENTING
TO BE BOUND BY THIS AGREEMENT between you and FuegoStar.com (En
Fuego Media Corp.). IF YOU DO NOT AGREE TO ALL OF THE TERMS OF
THIS AGREEMENT, DO NOT USE THE SITE. If eligible, users may participate
in the “rewards contest” conducted by FuegoStar.com.
FuegoStar.com reserves the right to change its policies, including
its incentive policies, at its sole discretion and at any time.
Members may receive prizes or cash payments after winning the
“rewards contests”.
2. Registration Information
You acknowledge and agree that in order for us to provide you
membership and related services, you must provide us with certain
information and we will maintain certain information about
you and your registration. Only one registration per individual
will be accepted.
3. Member Privacy
FuegoStar.com recognizes and respects the privacy expectations of
our members. For this reason, we do not share or sell member data/information
to anyone. Privacy disclosures are available to members for complete
information on how we handle member information. The disclosure
can be requested via phone, in person or through email request
on-line.
4. Disqualification
The following items are grounds for disqualification from Fuegostar.com:
The providing of false information, Tampering with the entry or
voting process or the operation of the contest, or any other attempt
to undermine the operation of the Fuegostar.com website including
the use of robotic, automatic, or programmed email or points methods.
Note: such actions are a violation of criminal and civil laws
and no such activity should take place, Fuegostar.com and/or any
of its sponsors reserve the right to seek damages from violator
or violators to the fullest extent permitted by law. Providing
e-mail addresses that are not valid when earning points through
the tell-a-buddy interface is not acceptable and Fuegostar.com
may, at its discretion, disqualify a member for taking such action,
"Spamming" (see "Anti-Spam Policy" below).
In the event that any of the above occur and the offending party
is a winner in any of the prize drawings, the prize would be forfeited
and an alternate winner would be selected at random. Sweepstakes
and Promotional Period of the prizes is identified with the start
date and the end date for that drawing. The Fuegostar.com promotional
period begins at the beginning of each month 12:00:01a.m. EST.,
then ends at 11:59:59 p.m. EST at the end of each month. Fuegostar.com
reserves the right to terminate or extend the promotion at its
discretion. In the event of termination, any prizes which are
announced and for which entries have been received will be awarded
on or before the entry deadline.
5. Eligibility
Registrant must be a resident of the United States, Canada, or
the United Kingdoms to take part in our online “rewards
contests”. A person may set up a maximum of one account
per person. By registering as a member of FuegoStar.com, you agree
to be bound by eligibility determinations made by FuegoStar.com,
which are final and binding in all respects. By registering with
FuegoStar.com, you agree that FuegoStar.com may send email messages
to you regarding your account or regarding news that is happening
on FuegoStar.com. If you are found to be fraudulently using the
system or duplicating entries, you will NOT be eligible to win any prizes, your account
will be terminated and all prizes will be forfeited. You are eligible
to participate in the FuegoStar.com “rewards contests”
as long as you reside in the United States, Canada or the United
Kingdom AND you are 18 years of age or older. FuegoStar.com reserves the right to close the
program at any time. You may not allow any other person to use
your unique account ID. FuegoStar.com reserves the right to not
pay individuals who attempt to defraud this system, and maintains
the right to press appropriate criminal charges or to institute
appropriate civil measures.
6. Drawings and Prize “rewards contests”
Each point that you have earned will be eligible for a prize.
The winners are chosen at random. Drawings will take place on
the 1st of the month after all points are counted for the month
that just ended. There is no fee for membership. Winner must have
all contact information up to date on Fuegostar.com, prizes will
not be sent unless all information is accurate. Members are responsible
for taxes due on any winning from Fuegostar.com. Members earning
more the $600 in the United States will have to submit a 1099
form from the IRS before any winning can be distributed. Members
are required to give all tax information to Fuegostar.com if requested.
Winners will be contacted by phone, email or by member login. Prizes
will be sent via standard courier, mail or any method
is best determined by Fuegostar.com. If we cannot contact the
winner via phone or email the winner will forfeit the prize. All
cash payments may be changed at anytime by Fuegostar.com. Cash
payments will be sent via paypal and after all the member’s
information has been verified and is 100% compliant with our rules.
FuegoStar.com is not responsible if you lose or misplace your
funds via email. Each month we will change the number of winners.
Our minimum amount will be one. At anytime this can change.
All winners will be chosen at random from the first winner to the
last winner.
7. Anti-Spam Policy
It is unacceptable to send unsolicited email to individuals that
you do not know personally. Sending such email is considered offensive
and will not be tolerated by Fuegostar.com or any Website with
which it is affiliated. If FuegoStar.com receives complaints about
any individual sending such messages to individuals other than
acceptable contacts (as determined by FuegoStar.com upon investigation),
the individual will become ineligible for any and all prizes
in the promotions / sweepstakes.
8. Limitations of Liability
Fuegostar.com is not responsible for any incorrect or inaccurate
information, whether it be user error or problems with equipment
or programming associated with or utilized in the sweepstakes.
Fuegostar.com further assumes no responsibility for any error,
omission, interruption, deletion, defect, delay in operation or
transmission, communications line failure, theft or destruction
or unauthorized access to the Website. Fuegostar.com is not responsible
for injury or damage to participants or to any other person's
computer related to or resulting from participating in this sweepstakes
or downloading materials from Fuegostar.com or its sponsors or
use of the Website. If, for any reason, the promotion / sweepstakes
is not capable of running as planned by reason of infection by
computer virus, worms, bugs, tampering, unauthorized intervention,
fraud, technical failures, or any other causes beyond the control
of Fuegostar.com which, in the sole opinion of Fuegostar.com could
corrupt or affect the administration, security, fairness, integrity
or proper conduct of the sweepstakes, sponsor reserves the right
at its sole discretion to cancel, terminate, modify or suspend
the Internet portion of this sweepstakes for any drawing(s) and
Internet entries received for that drawing prior to the action
taken. FuegoStar.com, its Licensees, affiliates, sponsors, subsidiaries,
and related companies, their advertising or promotion agencies
or their respective officers, directors, employees, representatives,
sponsors, and agents, WILL NOT be responsible or liable for any
damages or losses of any kind. All content, programs, and other
elements of the Fuegostar.com site are provided "as-is",
without warranty of any kind, either expressed or implied.
9. Disputes
By entering, you agree to these Official Rules and the decisions
of Fuegostar.com, which are final and binding in all respects.
As a condition of participating in this sweepstake, participant
agrees that any and all disputes which cannot be resolved between
the parties, and causes of action arising out of or connected
with this Promotion, shall be resolved individually, without resort
to any form of class action, exclusively, before a court located
in the City of Brooklyn, New York having competent jurisdiction,
without giving effect to the conflict of laws rules thereof, and
all proceedings shall take place in that State in the County of
Kings. which Court shall apply the laws of the State of New York
without regard for doctrines of Conflict of Law. Further, in any
such dispute, under no circumstances will participant be permitted
to obtain awards for, and hereby waives all rights to claim punitive,
incidental or consequential damages, or any other damages, including
attorneys' fees, other than participants actual costs associated
with entering this promotion.
10. Miscellaneous Provisions
Any issue or item not covered by these terms and conditions will
be determined by FuegoStar.com at its sole discretion.
